At Studio Inspatial, we are committed to providing exceptional design services and client satisfaction. This Refund and Project Cancellation Policy outlines the terms under which clients may request cancellations or refunds for interior design services.
1. General Policy Overview
By engaging our services, the client agrees to the terms outlined in this policy. This policy applies to all interior design services, including consultations, design plans, procurement, and project execution.
2. Booking Deposit & Initial Payment
- A non-refundable deposit of [10%] of the total project cost is required to confirm and initiate the project.
- This deposit secures your project in our schedule and covers initial consultation, design research, and concept development.
3. Project Cancellation by Client
If a client wishes to cancel the project, the following terms apply:
After Confirmation & Work Starts:
- Cancellation is allowed.
- The initial deposit is non-refundable.
After Concept Presentation but Before Procurement:
- A refund may be issued for any unutilized portion of payments made after deduction of time spent on design development (billed hourly or per milestone as stated in the agreement).
- Design files and deliverables will not be released unless payment for work completed has been settled.
After Procurement/Execution Begins:
- No refunds will be issued once materials have been ordered or the site work has commenced.
- Any third-party costs (materials, contractor advances, custom orders) already incurred are non-refundable.
4. Project Cancellation by Studio Inspatial
Studio Inspatial reserves the right to cancel a project under the following conditions:
- If the client is unresponsive for more than 15 business days without prior communication.
- If the client violates terms of engagement, including delayed payments, abusive behavior, or breach of agreement.
In such cases:
- The client will receive a written notice of termination.
- Refunds, if any, will be based on unutilized funds after deduction of work completed and costs incurred.
5. Refund on Products or Materials
- Custom or made-to-order furniture, fixtures, or décor items are non-refundable once the order is placed.
- Any damage or defect must be reported within 48 hours of delivery to qualify for repair or replacement as per vendor policy.
- Studio Inspatial is not responsible for third-party vendor warranties, delivery delays, or stock issues, though we will facilitate support wherever possible.
6. Timeline Delays
- If delays are caused by the client (lack of decisions, delayed payments, site access issues), Studio Inspatial is not liable for any penalties or refunds.
- If delays are due to Studio Inspatial and significantly affect the project delivery (beyond 30 days), a mutually agreed adjustment to timelines or partial refund may be considered.
7. Dispute Resolution
In case of disputes regarding refunds or cancellations:
- Both parties agree to attempt resolution via dialogue and mediation.
- If unresolved, the matter will be handled under applicable laws in the Bangalore Jurisdiction.
8. Governing Law & Jurisdiction
All disputes, controversies, or claims that are directly or indirectly caused by, arising from, or related to this Policy will be governed by Indian law and will be exclusively referred to confidential, mandatory, and binding courts located in Bengaluru, India. With the above being said, you consent to submit to the exclusive jurisdiction of the Courts located in Bengaluru, India.
9. Miscellaneous
- This Agreement constitutes the entire agreement between the parties and supersedes all prior negotiations or understandings.
- Any amendments must be in writing and signed by both parties.
- If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions shall remain in full force and effect.
